Lakeside Trust On Hold
31 March, 2004 Dear Mr. Milton, The Mayor has asked me to respond to your letter of 17 February 2004 and I apologise for the delay. Firstly, Council thanks you for the presentation to its Strategic and Commercial Services Committee on 10 February 2004. At its following General Meeting on 16 February 2004 Council considered the recommendations from its Strategic and Commercial Services Committee and resolved:
In respect 3 above I have sought legal advice on two options, these being, Council retaining ownership of the site and leasing the site on a long term basis to a Trust set up with specific operational parameters, or Council developing a Trust Deed through which Council transfers ownership of the site under specific conditions. On receipt of this legal advice the matter will be referred back to Council for consideration. Your suggestion that a Working Party be established to advance the Trust Proposal is noted and has merit, subject to the legal advice being sought regarding Council’s powers to enter in to such Trust arrangements. Council will be pursuing the Appeal to the Heritage Council as Council believes the Heritage Listing is too restrictive and would cause unnecessary bureaucracy and potential operational decision making delays to both Council as owner and any third party as Operator. Notwithstanding the Trust Proposal the Council has a resolution on its books to seek Expression of Interest (after the Heritage Listing Appeal) from interested parties/community groups for future utilisation of Lakeside. This may not be in conflict with the Trust Proposal in that it may bring to Council’s attention the level of community interest in utilising Lakeside and the possibility of including such utilisation under the Trust Proposal.
